This Acceptable Use Policy (“AUP”) sets out the standards that govern your use of services provided by Functiv (“we,” “our,” or “us”). Functiv delivers hosting services through trusted Verpex infrastructure (verpex.com), ensuring enterprise‑grade reliability and compliance. While Verpex provides the technical backbone, Functiv is responsible for the customer experience, support, and community standards that define our brand. Accordingly, this AUP incorporates Verpex’s Acceptable Use Policy requirements and adds Functiv’s own rules to reflect our values and operational practices. By using Functiv services, you agree to comply with both this AUP and Verpex’s Acceptable Use Policy. Any violation of Verpex’s AUP will be treated as a violation of this AUP.
Lawful Use
- You may not use our services for any unlawful purpose or in violation of applicable laws and regulations, including but not limited to UK, EU, US, or the jurisdiction in which the servers are located.
- Prohibited activities include, without limitation, hosting or distributing content that infringes intellectual property rights, promotes illegal activity, or violates data protection laws.
Security and Integrity
- You must not attempt to circumvent or compromise the security of our systems, networks, or services.
- Activities such as unauthorized access, probing, scanning, denial‑of‑service attacks, or distribution of malware are strictly prohibited.
- You are responsible for maintaining the security of your own accounts, passwords, and applications hosted on our platform.
Resource Usage
- Customers must use resources (including bandwidth, storage, and processing power) in a manner that does not adversely affect the stability or performance of the services for other users.
- Excessive or abusive consumption of resources may result in suspension or termination of services.
Content Restrictions
- You may not host, transmit, or distribute content that is abusive, harassing, defamatory, obscene, hateful, or otherwise objectionable.
- Content that promotes violence, discrimination, exploitation, or illegal activity is strictly prohibited.
- Functiv reserves the right to remove or disable access to any content that violates this AUP.
Email and Communications
- The use of our services to send unsolicited bulk email (“spam”) is prohibited.
- Customers must comply with applicable anti‑spam laws, including the UK Privacy and Electronic Communications Regulations (PECR) and the EU General Data Protection Regulation (GDPR).
- Marketing communications may only be sent to recipients who have provided valid consent.
Third‑Party Policies
- Because Functiv operates as a reseller of Verpex hosting services, you are required to comply with Verpex’s Acceptable Use Policy in addition to this AUP.
- In the event of a conflict between this AUP and Verpex’s AUP, Verpex’s AUP shall prevail.
Enforcement
- Violations of this AUP may result in suspension or termination of services, removal of content, and/or reporting to law enforcement authorities where appropriate.
- Functiv reserves the right to investigate suspected violations and to take any action deemed necessary to protect the integrity of our services and infrastructure.
Changes to this Policy
Functiv may update this AUP from time to time to reflect changes in law, technology, or operational requirements. Continued use of our services after such changes constitutes acceptance of the updated AUP.
